1923 saw the formation of the Sacramento Municipal Utility District by the vote of residents of the area. Despite this, PG&E in San Francisco would do everything it could to prevent this newly formed organization from providing power to its constituents until 1946, when a court of law would uphold SMUD’s right to produce and supply power to its customers. Unlike most power production companies, SMUD is not under the jurisdiction of the Federal Energy Regulatory Commission. Instead, it is a public agency of the State of California.
The battle between PSE&G and SMUD continues into the current day, with the most recent throwdown taking place in 2006 when PSE&G successfully prevented SMUD from expanding into Yolo County. This was a particularly bitter loss for SMUD after it had successfully annexed the people of FOLSOM into its area of control, wresting it from PSE&G.
